Client was charged with DUI 2nd offense (although she was properly a third offender) while asleep in her car in a truck stop. Tennessee’s law on being in physical control of a vehicle being sufficient for a DUI resulted in her arrest and charge with DUI 2nd. After obtaining the video, we were able to show her vehicle was watched for almost an hour while she slept before police arrested her while she was asleep in the car. After filing of motions, the state agreed to drop in the DUI in favor of a lesser offense. Client was able to remove interlock device from her vehicle (placed there via bond conditions after her arrest) and retain all of her previous driving privileges.
