Client was a 60 plus year old individual who had worked very hard his whole life, sustaining multiple injuries at work in addition to an injury just days before his arrest. He was driving an older work truck belonging to his business with front end problems. Client had previously received opiate medications in the past and after the injury used the prescribed medications moderately. His work truck was stopped by the Highway patrol in Smith County in which the trooper indicated our client was unsteady walking and arrested him for DUI. Our investigation showed witness that the truck was difficult to drive and that he had been significantly injured throughout his life and recently, resulting in his unsteady walk and a poor performance on the field sobriety test. After meeting with the district attorney general, all charges were dismissed with the exception of “driving outside a lane marked for travel”, receiving a $1 fine and court cost.
