Client and passenger were driving late at night with child in the backseat. Officer pulled client over for swerving outside the lines and asked client to perform field sobriety tests. Client has a medical condition that makes performing these tests very difficult. Officer arrests client and passenger on the basis of suspected Driving Under the Influence for the driver and Public Intoxication for the passenger. The Officer also charged them both with Reckless Endangerment since the child was in the back seat of the car. The client’s toxicology report showed there was no alcohol in the client’s system. Our office requested the client complete and Alcohol and Drug Assessment and provide documentation for his medical condition. When our office provided the District Attorney with all of the information we had gathered, both the client’s and the passenger’s charges were dismissed without payment of court costs.
