My client was stopped for a DUI in Mt. Juliet, Tennessee. They were also charged with leaving the scene of an accident and other traffic violations. A blood draw was obtained which showed a blood alcohol level of .30, in excess of 3 times the legal limit of .08. Our client had a prior conviction for DUI in 2019. An investigation showed the officer gained consent for the blood test in violation of Tennessee law at the time. Client had obtained an alcohol and drug assessment and agreed to 180 hours of inpatient treatment. As a result of their successful completion of the A&D Assessment and the inpatient treatment, the charge of DUI 2nd was reduced to DUI 1st with a 10 day sentence. This allowed our client to avoid the minimum sentence of 45 days to one year for DUI 2nd offense and the mandatory 2 year drivers suspension.
This case is considered a “complex” DUI case in that our client was charged with a DUI 2nd, leaving the scene of an accident, and multiple other traffic violations due to being involved in a traffic accident.
