Result: All charges dismissed
Client was blue lighted by the Lebanon Police Department after a driver called in indicating impaired driving. Client claimed he had been parked, off the road way located at the 840/I-40 exit. Client was deemed uncooperative and belligerent when he insisted there was nothing wrong with him parking on the side of the interstate. The officer asserted it was a homeland security issue and called in back up. A review of the video tape confirmed that while the client did insist he was doing nothing wrong, he was polite at all times while holding his position that his actions were permissible. The officer is heard on the video tape saying she cannot smell alcohol but he acted lethargic. Upon back up arriving, our client was arrested for DUI on the limited information previously stated. Client was charged with DUI 1st offense and violation of the State’s implied consent law. After review of the video tape and investigation into the arresting officer, all charges were dismissed without court cost.
