You’ll never know if a witness is lying if you don’t do your due diligence. We nailed this officer down on his testimony during the preliminary hearing, prior to receiving any discovery, about the traffic stop in this case. If we had waived the preliminary hearing, we wouldn’t have his sworn testimony to compare to the video. When we received and reviewed the discovery, it became clear that this officer didn’t just exaggerate or misremember. He lied, turning himself into the supercop of his dreams. We pulled the personnel file on the officer, and it turns out he was given the “option to resign” because he lied to his superior officer, too. The video evidence against our client was strong, but the State’s only witness had a real problem with the truth. If we hadn’t done our due diligence in this matter, we likely never would have known. Our client walked away with no jail time and no felonies.
