Violation: DUI – Driving while Under the Influence

Facing: Up to 11 months and 29 days imprisonment; Fine of up to $2,500.00; One year suspension of driving privileges.

Result: DUI case dismissed; no loss of license, no payment of court costs, or fines.

Additional Details: On Feburary 6, 2011, a police officer alleged that a vehicle being driven by a citizen was weaving. As a result of this stop of the citizen, the State of Tennessee alleged he had committed the crime of driving while impaired with a blood alcohol content over .17, well over the legal limit. Citing both the State and Federal Constitution and after a thorough investigation, Mr. Lannom filed a Motion to Suppress the Stop of the vehicle contending that the stop lacked the necessary probable cause to allow for seizure of his client’s vehicle. The motion was later granted resulting in the state being barred from using the illegally seized evidence. The charge of Driving while Under the Influence (DUI) was dismissed against the client, allowing him to maintain his license so that he could continue to work and support his family.
