Client was charged with domestic assault, sexual battery, and false imprisonment in Wilson County in 2024. The alleged dispute between the husband and wife resulted in the husband being arrested, taken to jail, and required to post a bond. Once the bond was posted, the husband was released with substantial bond conditions prohibiting his return to the marital home, the installation of a GPS monitoring device, and a stay away. The husband then contacted our office for representation where he learned that he was charged with a felony sexual offense that could have placed him on the sexual offender registry if convicted.
Throughout our representation, the bond conditions were gradually modified to allow the husband and wife to speak electronically, to have the GPS monitor removed, to have peaceful contact with one another, and return to the marital home.
Ultimately, we were able to negotiate with the District Attorney that the husband would complete a domestic violence intervention program. Upon successful completion of the program and continued peaceful contact between husband and wife, the case was completely dismissed upon a payment of court cost. The husband did not receive a criminal conviction, maintained his once-in-lifetime diversion status, and the case was expunged.
